      In the name of God Amen, I Jane Rash, formerly Jane Guinn, of the town of Stockwell in the County of Tippecanoe and State of Indiana, being of sound mind and memory, and considering the uncertainty of this frail and transitory life, do therefore make, ordain, publish and declare this to be my last will and testament; That is to say, First after all my legal debts are paid and discharged, I give and bequeath and dispose of as follows To wit, To my brother David Brinkly of Bath County Virginia Three hundred dollars, To my brother James of Gilmon County Virginia Three hundred dollars, To my brother Fleming Brinkly of Gilmon County Virginia, Three hundred dollars, To my sister Debora Haywood of Highland County Virginia Three hundred dollars, To my sister Agnes Smith of Bath County Virginia Three hundred dollars, To my sister Betsy Rowe of Bath County Virginia, Three hundred dollars, To my sister Kesiah Carter of Bentonsport Iowa, Eight hundred dollars, To my brother Christopher Brinkly of Tippecanoe County Indiana Three hundred dollars, To my Neice Anna Brinkly, for her kind attention in my sickness, Three Hundred dollars, To the children of my sister Mary deceased, of Bath County Virginia Three hundred dollars, To the children of my brother William Brinkly Two hundred dollars, To the Children of my brother John Brinkly Two hundred dollars, I hereby authorise and direct my exector to reserve one thousand dollars of my estate to defray the expenses of funeral, putting up a suitable monument, and otherwise improving the place of burial. The residue of my estate, if any, to be divided proportionately among the foregoing legatees and in order to pay the bequests as above directed, I hereby instruct and authorize my executor to convert all my property real and personal into cash as soon as it can be done in conformity to law. I hereby certify and aver the property and monies out of which the foregoing bequests are to be paid are my own separate property and held in my own right.
      In witness whereof I have hereunto affixed my hand and seal, hereby revoking all former wills made by me, and likewise constitute and appoint Samuel A. Cunningham executor of this my last will and testament. Signed this seventeenth day of June One thousand Eight hundred and Eighty five.

      Codicil 16 Nov 1885:
        Whereas I, Jane Rash formerly Jane Guinn of the town of Stockwell in the county of Tippecanoe and state of Indiana have made my last will and testament in writing bearing date the seventeenth day of June in the year of our Lord One thousand eight hundred and eighty five and by which I have given and bequeathed to my sister Keziah Carter of Bentonsport Iowa the sum of eight hundred dollars, now therefore I do by this my writing which I hereby declare to be a codicil to my las will and testament and to be taken as a part thereof, order and declare that my last will is that only the sum of Five hundred dollars be paid to the said Keziah Carter as the full amount bequeathed to her and that One hundred dollars be paid to Martin Royer in consideration of his kindness and care in my last sickness, and that an additional hundred dollars be given to my brother Christopher Brinkly, who has been to great trouble and care on account of my long illness. To the children of my brother John Brinkly of Virginia I give and bequeath the sum of Two hundred dollars, and lastly, it is my desire that this codicil be annexed to and made part of my last will and testament aforesaid, to all intents and purposes.

      -- Note that her brothers' residence should be Gilmore county, West Virginia. This will is a typed document, so was probably typed by the clerk from the original handwritten will.

    • From Charles Brinkley ( Ruth Jane's parents were Robert Brinkley and Elizabeth Keyser. Robert was the son of John and Ruth Brinkley. Elizabeth was the daughter of William and Keziah (Snead) Keyser. Connie Matheny found a filing in a Bath County Chancery Court box marked 1867, but the filing itself (which is hard to read) looks like it involved an action taken after Robert's death. If references an initial filing in 1851 and it is dated 14th of December 1852. The relevant section reads: "Your orator further represents that since the filing of the said original bill the said Robert Brinkley departed this life intestate leaving to survive him his widow Elizabeth Brinkley and the following named children and grandchildren to whom his lands descended as his heirs at law to wit: John A. Brinkley, William Brinkley, Margaret Brinkley, Christopher Brinkley, Sarah Brinkley, Agnes Brinkley, David Brinkley, Flemming Brinkley, James Brinkley, Austin Brinkley - Kesiah Carter wife of Robert S. Carter, Catherine Fishback wife of Franklin T. Fishbach, Deborah H. Shoultz wife of John Shoultz - Elizabeth Rough wife of Christian Rough, Jane Gwin wife of William Gwin (which was inserted between the lines as if a correction/ amendment) and John Krizer and Robert Krizer infants of tender years, children of Mary Krizer decd one of the daugthers of the said Robert Brinkley decd."
      Later in the filing, he repeats this language but changes the language to refer to the married daughters, Kesiah, Catherine, Deborah, Elizabeth and Jane individually as "his wife late [Kesiah/Catherine/Deborah/Elizabeth/Jane]Brinkley".
      On the front of the filing it say: "This day personally came the within named Alexander Sitlington [the orator] before me S A Porter Clerk of the Circuit Court of Bath County and made oath that the within named Robert S. Carter and Kesiah his wife and William Gwin and Jane his wife [again inserted above the line as if a correction/amendment] are not residents of the State of Virginia [hard to read but looks like:] or he has been informed and believes. Given under my hand this 14th day of December 1852. S.A. Porter".

      I didn't find a death record for Jane, but did find one for Daniel L. Rash: May 25, 1904. You might want to write the Tippecanoe Co. Public Library for his obituary.
