5 "In the District Court of the Ninth Judicial District of the State of Idaho, in and for The County of Bonneville. Rachel Hill, Plaintiff Arthur Hill, Defendant: Decree of Divorce.

This cause came on regularly for hearing before the Court sitting a jury, a jury having been expressly waived; the plaintiff being represented by Messers. Holden and Molt, representing W. A. Broadhead Hailey, Idaho, attorney for Plaintiff, and the said defendant being represented by A W. Holden, Esq.; and the demurrer heretofore filed the defendant was by the Court overruled; and the said defendant then there declined to plead further; and the default of defendant for to answer the complaint of plaintiff was duly entered. Whereupon the Court heard the testimony of plaintiff and her witnesses, and it appearing from said testimony that all of the material allegations of plaintiff’s complaint are true, and the Court being fully advised;

IT IS HEREBY ORDERD, ADJUDGED, AND DECREED THAT The bonds of now and heretofore existing between the said plaintiff and the said defendant be, and the same are, hereby dissolved and set aside; that said defendant shall have the care, custody and control of the minor children of plaintiff and defendant, Marvel Hill, Myrl Hill, and Hill, for a period of nine months in each year, said nine months during the school term; and that the plaintiff shall have the care, custody, and control of said minor children during the three summer months of each year; that both plaintiff and defendant shall have the right at all and any reasonable time and place, to see and visit with said children without hindrance form the other party in whose custody children might then be; that when the period of time shall arrive the custody of the children shall be give to the plaintiff the shall make the necessary arrangements for having the children sent or brought to her; and that when the defendants period of custody shall make the necessary arrangements to bring the children from the place where they might then be in the custody of the plaintiff. The three minor children shall not be taken from the State of Idaho the consent of the Judge of said Court first had and obtained, or the consent of the party other then the one in whose custody the might be in; and if said children, or any of them, are taken out to State of Idaho, they must be returned to the State in accordance with provisions of the written consent or agreement if they be taken out the State by other than a Court order:

AND IT IS FURTHER ORDERED, ADJUDGED, AND DECREED That each of said parties are to support the said children during the time either may them in their custody.

6 A book of abstracted marriage records shows the marriage date as 20 May 1875. "Thomas Wandless of Fton, to Dorcas Whitlock of St. Mary's, May 20, 1875, by G. Goddrich Roberts, Anglican, , Wit John Stephen, Martha Whitlock"
Arnold Duke checked the Christ Church cathedral records, which show 30 May 1874. It's puzzling that the book would list both a different date and church.

7 A letter written in Canada in 1893 by John Wanless, nephew of Isabella and son of her brother, John gives a description of their family.
"My father seems to remember things that happened in his boy days better than he can things of later dates and he says Uncle Dick has the Wanless catechism about right. Archibald and William had one sister Isabella, she was married to one Herbert. Their son Thomas Herbert came to America Father thinks about the year 22 or 23 but he does not know what place only he thinks he come to where some of the former ones came to and my father's mother's name was Gray and the first wife of my grandfather William of Biddlestone. His 2nd and 3rd wives were Cowan cousins. The first family was Margaret, George, John "my father," Tibby (Isabella), and William. William was the 7 mo. baby and kept for two months in a fleece of wool on the pot lid. Marg. was married to William Isabella Buckham, Family 7 sons and 2 daughters, 3 sons and 1 girl are dead. My uncle William's family are all dead but one girl. He is living not long ago and quite hearty and fresh. My father's uncle Arch died from home. He went to some of the summer fairs took sick when away and died at a place called Sunsidetownfoot. Archibald's son William my Father's cousin died a few miles from Biddlestone and his cousin Richard who would be about his age if living yet went to school together when his uncle Archibald lived at Fliup?My Father's half brothers and sisters and their families are many of them dead. Archibald's family 3 girls and 1 boy. The girls are married since we left the old country and are now living."

Though I never saw my great grandfather, Jim Wanless, I do
remember his wife. Great Grandma Josie (Minett). She was very
tall and lean. Perhaps everyone her age wore a "house dress" and
apron then. People were so very rigid and staunch in beliefs-
for instance, people didn't hug or cuddle children after the
toddler stage-lest it "spoil" a child. Such strict, stern
people as they were--they must have missed much happiness and
tenderness. I suppose enduring many hardships, working hard to
produce food, fuel, etc., there was a hardness built in! They
were devout Presbyterians, but even religion was so strict and
unbending, there wasn't gentleness in being a Christian, either.
My grandfather. Earl Wanless, was also lean and tall. He
was exceptionally clean, as I recall. Always wore bib overalls
for farm work, but was clean at any given time. He dressed as
for church to go to town or to a meeting. He was an early
generation in the Franklin Farmer's Insurance Company. He served
in the capacity of Town Chairman for many years, attended the
Fancy Creek Presbyterian Church faithfully. The Church was
located at the entrance of the Fancy Creek Cemetery, had a very
high ceiling, and was heated for more than a hundred years by two
large potbellied wood stoves. Finally, an oil burning stove was
installed and lit just previous to each service. The Church was
maintained frugally--no frills. When the membership deteriorated
so drastically as to cause its closing, the Church was torn down
and a marker set in its stead. Grandpa Earl died in ______ and
left Grandma (Helen McNelly) to live out a total of 101 years.
When I think of what luxury and entertainment, etc., are
available today and how little our ancestors had or even
considered, it is a drastic contrast. Grandpa dearly loved
listening to his radio--a little luxury which sat on a "stand" in
the corner of the dining room. He sat in his wood rocker with
leather seat (the living room was not used unless there was
"company"). He so enjoyed Red Skelton, Jack Benny, Gracie Alien,
and Lucille Ball. He got such pleasure from so little. I can't
remember Grandma ever sitting down just to listen to the radio
with him. She had to be busy elsewhere about the house.
My dad. Mills Wanless, was born in 1914, having brother John
Foster and Catherine Margaret as older brother and sister. He
was to have a younger sister, Avis Helen and a younger brother,
James Arnold in the future. His father. Earl Douglas and mother,
Helen McNelly, farmed on the home farm in Section 15 of Marshall
Township.
Mills completed only eight grades of school in the little
one-room school located in Gillingham--a two-mile walk to school
and then two miles home. His was not the only generation to make
that trek daily, as did his father and his children before the
years of busing. His eyesight was poor and kept him from a
continued education in high school.

Wanless - Walter
The marriage of Miss Sarah E. Walter and John A. Wauless of Moline took place at the home of the bride's parents, Mr. & Mrs. James M. Walter at 892(?) Fifth avenue Tuesday evening in the presence of a large number of friends and relatives. The rooms were charming with a profusion of cut flowers and potted plants, and brilliantly illuminated. The bride wore a charming gown of white silk. The Rev. W.S. Marquis of the Broadway Presbyterian church officiated. After the ceremony the wedding supper followed and the evening was delightfully spent in sociability. The many presents received were very handsome. Mr. & Mrs. Wauless will make their home for the present with Mr. & Mrs. Walter.

27 James was always a kind and loving husband and father. He was loved and respected by all who knew him. He came to S. Dak. in 1909 and filed a claim near the town of Strool. At an early age he joined the Methodist Church in Wisconsin, then later joined the Congregational Church at Pasque, S. Dak. He had been a patient suffer of rheumatism for many years which caused his death. Mother (Gracia) tells that he died of exhaustion after taking a death message to family five miles away in a storm and they didn't ask him in to rest so he had to walk the five miles back.. which actually caused his death.
The Wanless family lived in a sod house east of Strool (Prairie City) Typical sod house for the area, it was plastered with sand on the inside. Kenneth was born here with the aid of a mid-wife. A point of interest was that the Christmas tree was a tumble weed or a cactus. --Notes from Eunice Jacobson
